Savvas Product Safety Requirements

Vendor will comply with the following Savvas product safety standards for children’s product (defined as any consumer product primarily designed or intended for a child 12 years of age or younger) to the extent applicable to the product being purchased. A children’s product does not include a teacher’s edition, teacher supplementary materials or any equipment or materials used by the teacher and not designed primarily for children 12 or younger. For student materials, if the vendor is not certain whether a product is designed or intended for a child 12 years of age and younger, the product must comply with these standards. If any of these product safety requirements conflict with the terms of any supplier agreement between Savvas and Vendor that is effective after the date of this purchase order, the terms of the supplier agreement will govern.

1. Lead Paint Limit – Except for printing ink bonded to substrate, no children’s product shall contain lead paint or other surface coating in excess of limits established by Federal or state law.
2. Lead Content Limit – No children’s product shall contain total lead content in excess of limits established by Federal or state law.
3. Phthalates Limit – To the extent applicable, no children’s product shall contain phthalates in excess of limits established by Federal or state law.
4. To the extent applicable, toys or games for children 3 years of age or older that contain small parts, small balls, marbles or balloons must comply with the choking hazard warning labeling requirements.
5. Each toy or other article intended for use by children under 3 years of age must comply with the small parts ban. All stuffed or plush toys must comply with the small parts ban regardless of the age of the child for which these toys are intended.
6. To the extent applicable, each children’s product that is a toy shall comply with all applicable ASTM standards and applicable regulations.
7. (a) To the extent applicable to the children’s product(s) ordered on this purchase order, Vendor will:
(i) certify, as the domestic manufacturer, compliance to those standards above that are subject to a certification requirement in accordance with the Consumer Product Safety Act as amended (“CPSA”); or
(ii) provide a test report of compliance to those standards above that are subject to a certification requirement under the CPSA from an accredited third party laboratory, if Savvas is the importer of record;
(iii) provide annually and at such other times as required in Paragraph 7(c) written assurance that the children’s products comply with those standards above that are not currently subject to a certification requirement by the CPSA.
(b) (i) Vendor will email a pdf of the certificate or test report to supplierproductsafetycertificates@savvas.com at least two business days before delivery of the product and indicate in the subject line of the email and as pdf file name: 10 digit ISBN, print number—year, and title of the product printed on the purchase order (e.g., 0328598968_5-17_MTH10 RTI STDNT MANIPS KIT GR. K). The email should cover only one ISBN, but may address more than one safety standard.
(ii) Vendor will email a pdf of the written assurance to the address referenced in Paragraph 7(b)(i) annually, subject to the requirement in Paragraph 7(c). The subject line of the email must include Vendor Name, the words “Safety Assurance Statement” and date of the statement.
(c) Vendor will provide an updated or new assurance to the address referenced in Paragraph 7(b)(i) if the components, source of components or manufacturing process for any of its children’s product changes.
8. Permanent distinguishing marks must be placed on all children’s product and its packaging manufactured on or after August 14, 2009, to the extent practicable, that specify the manufacturer, location and date of manufacture and other identifying product information, including the batch and run number. Note: Vendor may use codes to display the production information on the labels, so long as Vendor can ascertain and provide the actual information by reference to the codes.

Vendor will comply with all product safety federal, state, local and international statutes, laws and regulations applicable to the product manufactured, assembled or distributed to Savvas by Vendor, including, without limitation, any non-children’s product.

Notwithstanding anything to the contrary in these Savvas product safety standards, Vendor will not manufacture, assemble and/or distribute to Savvas any product, including, without limitation, any non-children’s product containing a chemical or substance subject to a labeling requirement under any federal, state (e.g. California Proposition 65) or international statutes, laws or regulations.
